Letter to The Right Honourable Jason Kenney
Ontario regulation 73/20 suspended lien limitation periods and procedural time periods retroactive to March 16, 2020. As the Ontario Government acted quickly to assist business, an unintended consequence resulted in non-payment of holdbacks. The CISC reached out directly to the Ontario Government and in tandem, worked with other associations to change the legislation. We are pleased to advise the Ontario Government on April 10, 2020 amended the legislation to allow for release of holdbacks.

Furthermore, as a National Association, we proactively wrote to the other Provinces to prevent similar legislation being passed. Due to this intervention, Alberta has recognized the concern and taken necessary action to avoid a similar problem. We anticipate the other Provinces will follow Ontario and Alberta’s lead.
